I hope once DOS decides to change the spillover and give the extra visas to Eb3 (whoever ROW , India....). The ensuing discussions from from the self glorified EB2 crowd here would make for an entertaining reading. I would like to see how much they enjoy the predictions after that.
Changing to vertical spillover will NOT help EB3 India or China. EB3 ROW is not current and it will suck up all overflow leaving EB2I, EB2C, EB3I and EB3C to their annual quota only. USCIS changing the process to horizontal spillover is the best thing that has happened to I and C community in the absence of immigration reform. Now there is at least some hope for EB3 folks to get a new job and apply in EB2, as at least that queue is faster. so you don't see a difference in how a private organization and a non-profit organization operates. Well here are some:
1. In your office, you are actually working for your boss and you are getting paid to do what they want you to do. I don't remember getting any pay check from IV. In fact, I have written several checks to IV. This doesn't mean I can post whatever I want but as long as I am following IV guidelines, I shouldn't get harassed by folks like you who think that their post is the only important post.

I understand that Immigration bill is not an easy one to pass. If it is being introduced again, hopefully they are not going to have the exact same wordings. I am sure they would have learnt something from the previous failures and come to some agreeable compromise.
So i think it is good to have some hope and work towards making it happen. Lets not worry about failure. We have nothing much to lose.

Yes all the above/below said happened to a foreign citizen(you) not to their own citizens when they apply for passport renewal.
But indian consulates show their skills to their own people.No other consulate/government offices in the world treats their own citizen in similar manner.
The only time I have had to deal with the Houston Consulate (or any Indian Consualate in the US) was last year when I needed a new/renewed passport. Sent it by mail and received it back in 1 week. I really can't complain since it's the best experience I have had with any consulate.
I applied for a UK visa, and they stuck someone else's visa in my passport. To call them, there's only a paid line for 99c a minute, even if it's their fault. And I was put on hold for 15 mins.
Applied for a Canadian visa, 3 mnths in advance of my trip. When I asked after 3 weeks, they told me pretty rudely that of I enquire about the status, it'll take even longer to process. (This is a tactic I would love to use with my boss whenever he asks about the status of things I'm working on) :) Finally processed it in 2.5 months. This was a simple single entry for 4 days.
Applied for a schengen visa(Germany), they took 3 weeks to process a simple business visa. Sent back my documents saying that I didn't have coverage for repatriation of corpse should I die in Europe, even though my policy clearly had it and this was verified when I presented the documents in person at the consulate. Schengen countries demand that you apply in person, because they want to make sure you have the face for going to Europe.
I have a Dutch friend whose Indian wife took 3 mnths to get a visitor visa. This is because he complained to the Dutch foreign ministry when her visa wasn't done in 3 weeks. He was outraged that the wife of a Dutch citizen should be treated by his govt. like that. Oh well, they showed him.
So given all this, I would assume that all embassies/consulates are inefficient, simply because they are government workers who are not answerable to anyone and can't get fired. And they work in a monopoly.
Of course, we like to think Indian babus are either stupid, lazy, corrupt or a combination of the above because it's a mindset we have. But looking at how USCIS and the embassies above operate, I think Indians are pretty much on par with everyone else.

Contractor on the other hand gets paid more, gets to work on different projects . There is some uncertaininty due to job changes etc but if we are tracking it right its works well, in my last 4 yrs of contracting never been out of job.
6. What I have seen by the way you bash others in this thread shows that you somehow think you are superior to others(which is okay if you keep it to yourself). Pardon me for saying this, you are stepping over the line. Few days ago there was a thread where one guy got banned due to some stupid comments like you about fake degrees, fake resumes and that he was somehow more deserving of the GC than the others.

US considers 16years of full time or equivalent of full time education as Bachelors degress(12yrs school + 4 yrs college/universit degree). Even Indian Bachelors of 3 yrs(12yrs school + 3 yrs coll/Univ) is not considered to be equivalent of US Bachelors.
From what my attorney told me,
1)16yrs of education(US Bachelors)/Indian 3 yr bachelors & 2/3years of Masters + 5 years experience qualifies for EB2 category.
2)15yrs of education(India Bachelors) + 5 or more years of education qualifies for EB3 cateogry.
3)Not sure of Diploma

This not even equivalent of Indian bachelors, you can substitute your job experience towards educational years. But I do not know whether that can be done for Diploma.
What I have said is my opinion, personal view, please do not construe this as legal opinion. I suggest you consult a good education evaluation companies like Trustforte, Mulinational Education & Information Services to find whether your case will qualify for EB3.

I think as a next step I will contact my Congressman after the Feb dates are released and we are still current. Do you know if it makes more sense to approach Congressman or Senator for this ? Also should I approach only 1 rep like 1 Congressman or approach both my district congressman and 2 state senators ?

Most likely, if dates are outside advertised processing dates, they will send standard reply that your case is pending, or if by that time there is a retrogression (and your PD is not current any more), they will simply say that your PD is not current (they also attach a copy of latest bulletin). Sometimes they wait until retrogression happens, so that they can provide a convenient reply. That's what happened on Ombudsman's intervention in my case.

It's a different story that by the time, we all become 65, the SS coffers will be empty. Of course, I wish no one is in a position where they need SS to survive.

o Nothing materially and noticeably. A minor nuisance out of the way.
- What did you do on the day you received it?
o Was glad but no celebration.

o Yes for a while. But the entire episode changed my outlook and showed me a different perspective. After being frustrated for a while I realized I should not called myself �skilled� if I cannot navigate the rather simple green card mess. People are successful despite extraordinary physical handicaps and here I was restraining myself under the simple excuse of GC. I realized that I had to and could create oppurtunities for myself, without GC and without being in the US. Fortunately at that very time I got my EAD (June 2007). I gave myself a hard limit of 1 year and if GC did not materialize in a year I would ditch the effort and move to plan B. By april this year I began taking steps towards a change of job. My prospective job title was going were different but I was willing to risk the GC. Now I was wishing I should not get a GC since I would need to shelve plan B for 6 months. And suddenly on May 1st I got the GC, just when I did not want it!

o Tremendously. When GC was important to me, it gave me a platform where I could act to make a change. I haven�t been active but just contributed a couple of hundred dollars to the cause.

o Nothing materially and noticeably. A minor nuisance out of the way.
- What did you do on the day you received it?
o Was glad but no celebration.
- How did the long wait upset your life?
o Yes for a while. But the entire episode changed my outlook and showed me a different perspective. After being frustrated for a while I realized I should not called myself �skilled� if I cannot navigate the rather simple green card mess. People are successful despite extraordinary physical handicaps and here I was restraining myself under the simple excuse of GC. I realized that I had to and could create oppurtunities for myself, without GC and without being in the US. Fortunately at that very time I got my EAD (June 2007). I gave myself a hard limit of 1 year and if GC did not materialize in a year I would ditch the effort and move to plan B. By april this year I began taking steps towards a change of job. My prospective job title was going were different but I was willing to risk the GC. Now I was wishing I should not get a GC since I would need to shelve plan B for 6 months. And suddenly on May 1st I got the GC, just when I did not want it!

o Tremendously. When GC was important to me, it gave me a platform where I could act to make a change. I haven�t been active but just contributed a couple of hundred dollars to the cause.
- Would you like to continue your support to immigration voice and help others waiting?
o No, the cause has long ceased to be important to me.
- Any advice for everyone?
o Don�t create impediments for yourself by hanging onto GC and getting frustrated. Move on, there is plenty of good life outside clutches of GC!

Thanks. Atleast my employer paid the fees. Now hoping that the refile will work.
