    If the supporting documents are not complete or if USCIS wants more evidence, you should get an RFE. USCIS post Receipt Notice only after they make sure that at least the very mandatory supporting gdocuments are in proper order!

    All,

    1.Did anybody have recently got H1B stamping done in Hyderabad consultate.
    2. Any issues with getting appointment dates.
    3. I have all the documentation in place including pay stubs in the last 8 years.
    4. Is it preferable to get stamping done in Canada than in Hyderabad,
    5. How many days does it take to get the passport back.


    Please share me your experiences,

    Are there instances where the processing time before interview will exceed to more than 3 mos? Is it also true that during the embassy interview, you are currently working? I am a nurse and my agency told me that I should still be practicing as a nurse during the time my packet 4 comes.

    I'm really having some problems because I am intending to go to Ireland by June. But now here comes the Mar 1, 06 PD. What if it would take me again another year to wait for my US visa. I am really sick of waiting.

    Hi,
    There is likely to be a change in my reporting manager. My current reporting manager will still be in the company in a new role, but I will be reporting to a new manager.

    My PERM application (LC) was filed in mid Jan '09, and is still being processed. I would like to know if this will affect my PERM application in any way.

    Nothing else has changed since i took up this position, same title, salary, location etc.,

    I have not found much info on this topic and so, decided to post this question.Thanks in advance for your replies.

    It looks staged, the way camera moves to audience before they change their expressions, and captures the falling gum balls from the bottom of jars. Even the expressions or audience are so exaggerated.

    Also the numbers he is reporting might be cooked by himself with no proof or source provided where he took his numbers from.

    Despite that, the argument he is provinding, itself should be given to support more immigration.

    Population of all developed countries is in decline. So they are encouraging young people from other countries to support their economies. Now with so many baby boomers starting to retire, the working population of USA is not just stabilizing as he chose to say but going to decline. To support the US economy it needs young people to immigrate so that the baby boomers like himself can keep getting their social security checks in mail. So his argument is not persuasive enough to people who know better. But the problem is most people who don't know enough about immigration or economy can easily be brainwashed to become anti-immigration with this kind of pseudologic hogwash.

    this is an attorney question. also this forum is for employment based green card issues. please check with ur attorney.

    Can you please help me figure out how to calculate the eligibility for citizenship. If one married a US citizen. Obtained conditional residency, the temporary green card, then forgot to apply to remove conditions. So re-applied for green card, and was granted. The parties have been married 5 years. Will the initial 2 years spent as a conditional resident count towards the 3 years for the citizenship? Again, I want to stress out that after the initial 2 years in conditional permanent residency, forgot to remove conditions, and a new application for green card was needed. However this time the permanent green card was given. Or will she have to wait another 3 years from now on with the permanent green card until applying for the citizenship?

    I appreciate any help.

    actually there is, if you do it my way you see an x, y and z level: there you can enter numbers, for example x= 3 and Y=5 and then you will see he will rotate differant.

    Here is my situation:

    I was joined as a contractor at CLIENT through client's preferred VENDOR. My paystub runs by my EMPLOYER. I use to submit my timesheets to my EMPLOYER and VENDOR every week. My EMPLOYER runs my paystub everymonth with minimum pay amount and not as per actual earnings. For ex:my actuals were $9500/- per month, he rans for only $6000/- every month. This gap is because he says he didn't receive the payments from VENDOR. With these gaps everymonth the dues between my employer and me has increased a lot, and my employer has to pay to me some $xx thousands dollars. There is no document/written evidence with me from my employer. My employer always tells me on phone, how much they paid to me and how much of mine they are holding.

    After my contract completion(for ex:10/30/09) at CLIENT, I joined and started as a Full Time Salaried employee at CLIENT on 11/5/2009. I submitted my resignation to my previous EMPLOYER on 11/16/2009.

    I have to collect my dues(ex: $xx thousands) from previous EMPLOYER. How can I proceed further to collect these dues, as there is no document / written evidence with me from him. My previous employer always communicate with me on phone to update the money transactions.

    My current visa status is, I am a Green Card holder.

    Please help me how to proceed in collecting my dues from my previous employer.

    Hello All:

    We got our FP done yesterday at the Atlanta ASC and thought I would share the experience and procedures incase anyone was interested or looking for this info.

    Received FP notice on 3/5/08 for FP appointment on 3/19/08 11:00am at 1255 Collier Road, Atlanta, GA 30318.

    We reached the ASC on time. At the door the security guard checks the FP notice and verifies your identity with either a Passport, GC or DL. We only showed our DL and it was fine. NO BAGS and NO CELLPHONES allowed. Was asked to leave my wife's bag in the car. Also, they will not allow ANYONE except the person with appointment in the office. I saw spouses who didnt have appointment waiting outside.

    You then go into the office (which is basically a BIG room) with seats and fingerprint stations and the FP notice and ID was checked again and given a form to fill out. Simple form, nothing different. All the information needed on the form (A#, Receipt No.) is on your FP notice. You fill out the form, return it and get a ticket to wait in line. The receptionist also Stamped the FP Notice at this point. We saw approx 80 people all with the same appointment time.

    When your number is called or shows up on the counter, they look at your documents again and took us to a FP station. FP Notice was scanned in and was asked to verify the spelling of my name and Address. Then they took FP of all 10 fingers, then again of Index Finger (both hands) and the again of both Thumbs. He saw the FP on the monitor and retook some of the FP again. After that, Picture was taken. The FP Technician then signed the FP notice on the stamp given earlier.

    The entire process from before entering to exiting took about 1.5 hours. I would recommend you take a book or magazine to pass some time.

    Sorry for the long post but just thought someone might be looking for this information. I am not aware if any of this information for the other centers.

    Hi

    USCIS mails are NOT forwarded.

    When you update the USCIS about address change.You will get confirmation ( may take 30days ) that the address is changed to ur new address.

    If the EAD is approved before confirmation the EAD will go to the old address and returned to USCIS.Then Again you need to ask them to resend.

    Now a days Iam seeing may people loosing EAds in mail.Even I lost the EAd in the mail because of address change and it never reached new/old/USCIS. I had to apply for replacement card. ( I don't want to scare You).

    May be you go to local USCIS office and check what address they have on file.

    Yes. Your H-1B only allows you to work in that position, for the H-1B employer.

    Also, if I am approved for an EAD down the road, can I use the EAD to do acting work on the side?

    Yes, however you will also need to use the EAD to authorize you to continue the computer programmer position. As mentioned above, once you work as an actor, you have violated the H-1B status and cannot use it even for the programmer position.

    You want him to work with GC or just want to keep him working. ?
    Eventhough the GC application is denied for EB1, you can process EB2 or keep him O-1 or H1B. For EB1, there will be strict rules by USCIS. If your company didn't meet the criteria for it, forget about it. Do it in EB2.


    We hired a scientist with O-1 visa two year ago (company provided all the documents). This scientist applied green card (EB-1) last year. This week he recived a letter rejecting his application. The reason is not about his personal qualification but is about the company. Letter says company had no publications although we provided the copies of US patent applications.

    We are a small R&D company with no budget for and work plan for any kind paper writing. Can INS use "without publication" as the only reason to turn down the EB-1 type application?

    This scientist is very important to our company. What shoul we do to let INS reconsider this decision?
