    Meet your Legislators:

    Immigration Voice plans to organize a nationwide meet-the-lawmaker drives in every state and every district. Two of our volunteers – Varsha and Sanjay – would be helping us to organize this. If you would like to meet with your lawmakers during this recess, then please email Varsha and Sanjay at varsha@immigrationvoice.org and sanjay@immigrationvoice.org respectively and simply put “Need Meeting Info” in the subject line of Email. They will send you all the information that you need on seeking the appointment, taking the right material with you, making a good case for reform and doing the follow-ups if necessary.

    Feel free to ask Varsha and Sanjay for any other questions that you have. They have met with their Congressmen and Senators a few times and they would be glad to help you do the same thing in your state and district.

    A Perfect Opportunity:

    This is the perfect time to meet the lawmakers, as they would be in their constituencies just before they go back to work on Immigration this spring and summer. In order to capitalize on this opportunity, it is very important that everyone meet with his or her legislators locally during this Easter recess of Congress. The members of the House will be in their districts between 2nd April and 13th April. The members of the Senate will be in their states between 2nd April and 9th April.

    Please use the time between now and the Easter recess to seek appointments to meet with your Congressmen and Senators in order to draw their attention on the need for reform in high-skills immigration.

    I don't know if my NC is cleared. Tried to find it couple of times calling over phone but always ran into unfriendly IO officers.

    Got out of BEC in dec 2006, I140 cleared in Jan 2007 but then my PD became current only in June 2007. And due to laziness of my law firm, my I-485 filing did not happen in June and got dragged into July 07 mess.

    I think if USCIS had initiated my Namecheck as per normal timeline (sometime around when my I-485 filed , i.e anywhere between July - Sep 2007), then yes, I think it crossed 180 days long time back.

    May be even though your PD is current,but according to CIS shit rule your receive date should also fall under the ProcessingDates and then only IO will look over your case i guess...:(

    This is what happened when i was current in May/June'08 told by Infopass/IO response..again back to circle waiting waiting..

    This type of clause is to protect employer for one year. Usually, it is not only trainig cost, it is business also.

    You can seek legal protection, complain USCIS and so on. When an employee joins contracts are for 12 months, when you work on niche technology, it will be confidentiality agreement for 2-3 years, and so on. Mostly they are goodwill agreements. If you have problem in signing for this 12 months, how would you be signing technology related agreements?

    I have seen business to business relationship broken due to employee running away from clients location. In the begining, even if formal training is not there, clients do compromize to bring to speed. Most of the consultant placements are business to business chains.

    Do you intend to break before 12 months?

    I have signed for confidentiality contracts up to 5 years, and refused to sign, when wanted not to honour contract, thereby not working for those clients.

    If possible avoid troubles otherwise, you already have several suggestions.

    Hi Shamu,
    A colleague/friend of mine and his wife decided to have a home delivery. So, they contacted this nurse practitioner/midwife, who used to come to his home once a month and do all the stuff that goes along with pregnancy. They also delivered the baby at his home, which took off all the expense that are associated with a hospital delivery and I'm pretty sure the entire cost for the 9 month term was <5K (actually around 2-3K).
    But I believe that was possible because it was a normal delivery with no complications.
    So, if you and your wife are in the same situation as most of the people here (i.e. late 20's or early to mid 30's ) there is no reason why you would not have a normal uncomplicated delivery. So having a home delivery is an option.

    I am a father of a 15 month old and felt that most of the months that we went to visit the doctor was pretty superficial. They did not tell us anything which you cannot find out from the internet or the maternity books. Who delivered my daughter in the hospital? Well a nurse did.

    Also in India my wife told me that most often women don't go to the doctor unless there are issues. (For the period leading up to the delivery. For delivery they go to the doctor.)
    So, for uncomplicated deliveries a home delivery could be an option, just check it out and the nurse practitioners (OBGYN variety)/midwives are fully qualified and sometimes more experienced than the doctors as that is ALL they do, they deliver babies.

    So check this option if you feel it is OK.
    Good luck with your insurance search.

    P.S.: Also you seem a little stressed out.
    Buddy enjoy this time, you are going to be a father. :-)

    That may be but do you actually think this practice is fair and should be legal. To me and hundreds of thousands of other folks who are patiently waiting in line, it is fraud because you are cutting in line. The sad part is we see that you are cutting in line but we can't do s**t about it just because it's legal.

    Why do we all start complaining when illegals get preferential treatment than us? We all start saying that we came here legally, we pay taxes, we waited in line, we did everything by the book.. bla bla bla. Well .. they are also getting their gc legally so the why do we complain?
    we complain about illegals because their very presence here without papers is ILLEGAL. what part of ILLEGAL do you not understand?

    as far as I can tell, gmatch is not doing anything ILLEGAL. as for the practice being FAIR or NOT, that is a separate discussion.

    WASHINGTON � Democrats are trying once again to advance legislation that would give some young illegal immigrants a chance to live legally in the U.S.

    Sen. Dick Durbin of Illinois plans to file a new DREAM Act bill on Wednesday. In the House, Rep. Howard Berman of California plans to file similar legislation.

    Generally, to qualify the young immigrants must have a high school diploma or the equivalent and have spent two years in college or the military. They must have been under 16 when they arrived in the U.S.

    At least one Republican, Rep. Ileana Ros-Lehtinen of Florida, is co-sponsoring the House bill.

    The bill filings would follow a speech Tuesday in Texas on immigration by President Barack Obama.

    I came through SFO a few days ago. I was prepared to leave if told that I could not stay, (having lost my job last November and not having found another). I was asked if I was still working for the petitioner, I replied truthfully that I was not and that I was looking for another job. I was then told it was OK, and "welcome back".

    I've got a code I biometric notice eventhough I did not apply for and EAD. What might this mean? Thanks to USCIS I lost a 2004 PD ...now its a 8/2006 PD.

    In the meanwhile I have a Phd offer from a top UK university and am planning to take that opportunity, even though I have an admission to a Master's here with full scholarship.


    Bluekayal Sorry to hear that you are still stuck in this mess. I am still in the university this is my second job change after GC. Hope your job and GC situation change to positive soon.

    Thanks for the link to the summary. But therein itself lies the solution. As you can see from the summary, the EAD eligibility in all cases explained above is in cases which does not impact the GC quota. Apparently, people against whom removal process is initiated is eligible to receive an EAD!!! Also, as you mentioned in your post, the CFR is not a law, it is an interpretation of law made by the agencies and the agencies are free to change the applicability, extension, conditions of eligibility for EAD as they seem fit. The reason is because COngress never foresaw these huge wait times when they passed the INA (in fact our FAQs make that pretty clear). I think if a little bit of persuasion is applied by the right people to the right places, we may just make this work. I agree with Raj, maybe we should take this a bit farther and see what develops.

    Another compelling reason for doing this is the fact that even if the CIR were to be passed, by the time the agencies develop their regulations we are easily looking at another 2 yrs plus before we see the effects of the CIR.

    I guess I am done on this topic. It was just a thought that I felt should be put out there for discussion.

    I’ve been reading too many posts, queries and concerns and feel that I am not sailing alone.

    I have a few questions:

    1) How does USCIS work? Do they have a set of rules? Is there a law stating they would provide AP or EAD (for all legal eligible cases) within 90, 120, 150 or 200 days?

    2) How can a person who is trying to immigrate legally (tax paying) make USCIS answerable for all these delays?

    3) Does the law of the land provide any opportunity for us (people trying to immigrate legally) to question USCIS for the delay?

    I’m all questions. Please share your thoughts….

    Need suggestion how to proceed with my new approved I140.

    I have two approved LC.

    1. PD EB3 SEP 2003 for which my I140 was approved and I have applied 485 during July 2007.

    2. PD EB3 MAR 2002 I got my I140 approval yesterday.

    All for same company.

    Is it possible for me use my new I140 for my 485 which I have I filled already? I have requested my company’s attorney to find options.

    I'm certain you cannot do that. While applying for H1B Visa, you can use experience in lieu of education, but while Perm/I140, they consider only 1 degree. Either its Masters or its Bachelors...even both of them are not considered as aggregates.

    If your attorney is planning that way, he may not have handled such cases before... :eek:

    You cannot substitute degree with experience while applying for Perm/I140.
    WhiteStallion is right. I received ref on my EB2 due to combination of degrees. However, once filed with single degree as Master's it was approved
