Senate Judiciary Committee Chairman Arlen Specter (R-Pa.) needed the assistance of the White House in early 2005 to overcome opposition within his own party to his chairmanship. In late November, Specter repaid the Bush Administration by unveiling draft legislation that would bring about a massive increase in government- mandated immigration to the U.S.
President Bush, in his immigration address on November 28, pledged to work for an increase in the number of green cards issued each year and stated his intent to work with Sen. Specter to bring it about. Specter�s draft legislation would send government mandated immigration levels into the 2 million-a-year range.
Under Specter�s draft legislation, the cap on family-preference immigration would be increased by 254,000 visas annually and hundreds of thousands of additional relatives would be exempted from annual limits. In addition, Specter proposes raising the cap on employment-based immigration by 150,000 a year, and allocating any unused visas to other preference categories.

Initially I ignored this thread as some advertisement. Then I noticed that this thread was staying visible for several days. I got curious and started reading it and following the posts - Got convinced - Purchased the plan 2 days ago and I got my Vonage adapter today. I can now make long distance calls and calls to India all inclusive the 25 plus taxes.

I have an employment-based petition and I'm presently unemployed. From what I understand, the sponsoring employer can hire me when I get my green card. So, when I get my EAD, which is most probably in 3 months, can I use it to work for whomever I wish?
If an employer files for your green card and you do not work for the employer, it is considered a visa fraud. Also, you have to wait for 180 days after applying for I-485 to be eligible to work for an employer other than the one who filed your labor.
Since you are in the country illegally, it would probably be faster for you to get permanent residency if the new immigration bill passes.

Enjoy greenhood..........no luck yet for my wife...But she got a call from USCIS office of Wash DC that it is the biometrics that is holding her approval...they are issuing a biometrics appointment....I told so far she had been issued Biometrics appointment thrice and we have not received anything.
Also if I got approved without biom availability how come she is not....she is giving crap that our job is approving the primary applicant....I told her that none of my friends have got approval just for the principal they all got approved together.
I told her Biom does not hold approval ...she was adamant we can't approve her w/o that.

I have an appointment at Kolkata on the 11th. Scheduled to fly back to US on the 26th. Considering Martin Luther king Jr day it will be 9 working days. After seeing the PIMS delays, I am seriously considering return back on AP. Cannot take the risk of delaying the flight as I dont have vacations to hang around and wait for PP.

I am also sacred because I did not apply for any AP because at the time of applying for my 485 my H1B was valid (in fact it is valid till July 08).
So, what would you guys advise me to do:
(1) Go to Kolkata (with my 485 receipt notice, original) and return before my

Interesting Example of how the bubble bursts!
Here's a very interesting anecdote that describes how an 'asset bubble' builds up and what are its consequences.
Read it even if it confuses you a bit:confused:...things will be clear as you reach the end....
ANECDOTE -
Once there was a little island country. The land of this country was the tiny island itself. The total money in circulation was 2 dollar as there were only two pieces of 1 dollar coins circulating around.
1) There were 3 citizens living on this island country. A owned the land. B and C each owned 1 dollar.
2) B decided to purchase the land from A for 1 dollar. So, A and C now each own 1 dollar while B owned a piece of land that is worth 1 dollar.
The net asset of the country = 3 dollar.
3) C thought that since there is only one piece of land in the country and land is non produce able asset, its value must definitely go up. So, he borrowed 1 dollar from A and together with his own 1 dollar, he bought the land from B for 2 dollar.
A has a loan to C of 1 dollar, so his net asset is 1 dollar.
B sold his land and got 2 dollar, so his net asset is 2 dollar.
C owned the piece of land worth 2 dollar but with his 1 dollar debt to A, his net asset is 1 dollar.

(4) When the bubble burst, the fellow with cash is the winner. The fellows having the land or extending loan to others are the loser. The asset could shrink or in worst case, they go bankrupt.
(5) If there is another citizen D either holding a dollar or another piece of land but refrain to take part in the game. At the end of the day, he will neither win nor lose. But he will see the value of his money or land go up and down like a see saw.
(6) When the bubble was in the growing phase, everybody made money.

I thought each EB category could get upto 28.6% of 140000 = 40000 visas every fiscal year. So if EB1 uses up 5000 and EB2 takes the remaining 35000 and its annual allotment of 40000, EB3 does not get any spillover.
Thoughts?

Wanted to update on my Infopass appointment, I have multiple 485's pending based on separate 140's(one approved and other pending) with different A#'s and at different service centers. So was bit concerned. The IO informed me that all my 485's and 140's have been consolidated and all applications are in the same file at one service center so nothing to worry about. Guys,
I am not sure what others are doing, but as somebody said a flower campaign to the guys who support us may go against us, but I think that shoudl be sent to those who dont support.
I have written twice in the last week and today I am sending cards with a letter.
One simple way of sending very short messages is "I am EB3-India and due to to non-availablility of visas, I am going back to INdia". And tell your qualifications. This is the same story even with PhD holders in US whose job desc doesnt qulaify for EB2 or EB1. No offense any others, as I know many others got experience while some got education.
This is in fact true with 5 of my friends who left in 2007 just before that visa bulletin. They had good offers and they did not want to wait for the US GC.
Just send the loud message" UNLESS YOU DO SOMETHING, WE ARE GOING BACK.". Send the message in different ways.
And ofcors good to meet personally.

I am not sure how it is unfair on EB2. Didn't these folks apply for GC before us legally and stand in line sincerely (no labor subs) AND gather pertinent work exp and education?
I understand you are working on getting the numbers. I would wait to hear from you with those numbers.
It is one thing to feel wronged seeing a few examples of people abusing the porting but quite another to have a lawsuit alleging that this is a widespread activity and it is causing grievous delays for the ones waiting in EB2. I really don't believe it and feel it is insulting to a large majority of highly skilled and hard working immigrants who have/will legally port their EB3 PDs to EB2.

I have two approved I-140 (NIW/TSC 06/2006 and EB1A/NSC 07/2009) and a
pending I-485/TSC from 2007. I went infopass two weeks ago, and was told
that my I-485 was pre-adjudicated and assigned to IO on 08/2009. The
infopass officer kindly sent an e-mail to my IO requesting for update.
Yesterday, I received a letter saying "We are actively processing this case.
However, we have to perform additional review on this case and this has
caused a longer processing time. If you do not receive a decision or other
notice of action from us within 6 months of this letter, please call
customer service at the number provided below."
Does anyone received a similar letter? Is it just some letter or some problem
with my case. I have been in this country for 11 years, used up all 6 years
of H1b, renewed EAD three times, and tried service request, called IO, wrote
to Senators/first lady. Not sure what else I can do...
