HI ..most the CP filers are in US and contribute to Immigration Voice regularly. You can say by mistake or something else some people chose to go for Consular Processing when dates became current and they all are in bad shape at this time. If you think about those who applied for Cp being in US then you would realise 485 filers are too much priviledged in comparison of them.

Yeah - I should have clarified that when I said most - I was refering to people whose PD is before 2006.
not "most"!! only few have a wait of 3-4 years, most have a wait of over a decade....the numbers of applications pending at AOS stage at USCIS is scary

Regardless of what Oh's website says, I think it will happen.
It is all about politics. The Dems are trying to speed this up with bills etc., so that more GC holders can be naturalized as citizens and could vote for them (most immigrants genrally vote democratic) in Nov 2008. We (GC contenders) will simply hitch the ride.

1. The Feb bulletin would not have said EB-2 India had used up its annual limit.
2. The June Bulletin would not have said EB-3 will retrogress or become unavailable starting July [which starts a new quarter].

Anyone invoking AC21 with unapproved I-140?
It is risky to change employers after 180 days before I140 is approved. If it comes to issues, when USCIS realizes one changed employment before I140 was approved, USCIS needs to verify that the underlying I140 was approvable at the time the change of employment occurred. By approvable it means that at that time there was no reason to issue a major type RFE for pending I140. If, for instance, the USCIS notices that at the time one invoked AC-21 and I140 was not yet approved and the I140 petition did not include (or included incomplete) educational documentation, it will say that the I140 was NOT approvable due to material evidence missing. And, at that time AC-21 can't work and may cause huge issues. One should be very wary of this and in general attorneys advise to wait until I 140 is approved before invoking I140.

how can Latinos be deported? Could you please explain? Are you accusing that all Latinos in this country are here illegally?
If I were a person of Latino origin, I will be very angry with folks who assume that all Latinos are illegals.
And to all the guys replying to my earlier post that such laws will increase racial profiling etc. In my opinion laws to make illegal immigrants' life difficult is basically good for us. I totally agree that non-white folks will be inspected by cops during the initial period of enactment of the law. What's the big deal about it. We will be stopped by cops. They will check our papers and will leave us, won't they? The same is true for Latinos (if they are here legally). Like I have written earlier, I have been living in a county which has implemented 287 g for the last several years and I NEVER had any issue with this. I have personally met the county chief of cop who has been a very vocal supporter of the program and he did not immediately arrest me.
The cop will fine you if you did not have the insurance card; under the present bill, the latino has a chance of being deported and not fined......huge difference!

I called USCIS NSC yesterday and asked if my new approved I-140 was interfiled with my pending I-485. The IO asked me for my A# and then told me that she doesn't see the new I-140 starting with SRC on the system. She only sees the original I-140 with the LIN. It was very frustrating to hear this as I had called NSC a week before and the IO told me that the new I-140 is in the system and visa was available for me. However, I remembered that last week the IO did not ask me for my A#. She only asked for the receipt numbers of my pending I-485 and the new I-140.
Friends, what else can I do to make sure that my newly approved I-140 under EB2 is interfiled?
Speaking from my case, I called NSC for the same reason multiple times and every time the information I got (now looking back) was either useless or insignificant. Only one procedural info I got once was correct. They informed me that when you Interfile, your request goes into your file and no receipt or any other update is done to your case. When your 485 app RD becomes current and an IO picks up the case to work on it, should consider the Interfiling request. If your PD is then current due to the Interfiling request and every other detail on your 485 app is complete, your case is approved immediately. That is exactly what happened to my case. Calling them is less fruitful and more frustation. I only called them once a month after they changed their processing dates for the month just in the hope I may get lucky with an IIO who may give some info. Never did. I also took an Infopass, but that was fruitless too, as they also could not provide any information. Just asked me to wait until my RD becomes current.
Hope this gives you some perspective and lowers your anxiety.

AC 21 is complicated, the whole GC process is complicated. Lot of us are thinking 180 days ahead for changing employers.. please think about September 18th. We need to make a difference. What is the white man's (Europeans and others) visa to America then? I don't see any other ways people can come here on the same conditions as the H-1B visa.
Lol, it happens to be no visa!Most Europeans don't need a visa to get in this country and if they want to, they just stay back.....since they are are the same color as the majority they do not caste doubts or suspicions as much as the 'brown man' does....I don't think the majority of European immigrants to America came with any papers whatsoever......and lets not forget that before '65 race-based immigration was the policy.

Folks - here is what you all do.
Please contact the Ombudsman's office. Fill out the form 7001 and explain the issue in detail and attach copies of your MTR submissions, notices etc....
Contact your Senators - go to their websites and look for constituent services and follow what is there on their website.
Contact your Congresman - usually congressman's office will give more personal attention. I recommend that you personally go to COngressman's office and talk to the immigration expert there. They will help.
Also, please feel free to contact IV with the issue. You can sed me an email and I will forward it to IV core to see what can be done.
