Yes, you can hold on to the priority date if you have copy of approved I-140 and you old company doesn't revoke the I-140.
b) If this Company B were to file for H1-B , as I understand it would count towards the 2007-2008 quota which opens on April 1st '07...does this scenario also force you to not start working till Oct'07 (which is when ppl who file in the 2007-08 quota are supposed to start working).
If you are already on a H1 and are only doing a H1B transfer, it will not not count towards quota (unless your current H1B is for non-profit org and new H1B is for a for-profit org). You can start working as soon as you get the receipt. But, if you are applying for a fresh H1B, it will count towards quota and you will have to wait till Oct 07 before starting to work.

As far as I know, nothing that is being considered in the Senate is going to relieve the Green Card backlog.
They have plans to eliminate the backlog in 5 to 8 years not immediately. So if one chooses not to re-apply under the new point based system, waiting time doesnt change much for him. (It may be become worse because they are cutting down immigrant visas in EB category from 130k to 90k)
But if one decides to re-apply under the new point based system, things may become faster.
I am hoping that under the new system, they will give some priority to people who already waited for a significant amount of time under the old system.
This is just my analysis based on the articles I read on the internet and the bill text itself.

I am a freelance book writer and a web market engeneer;
In 2005 I was let go from my job; I filed for unemployment and I traveld to Asia working part time as writer and looking for a new job and find new places to write about in my book;
the trip lasted 5 months,
I attached my taxes for the last 5 years to the application:
will CIS look at the taxes for 2005 and look at the unemployment benefits together with my international travel?
AM I in trouble when I show up for the interview? I am concerned

I dont think international travel should be a problem as long as you have spent more than half of your last 5 years in the US.
I have heard (IANAL - so please double check) Unemployment benefit is an insurance claim. Your employer (and indirectly you, in the form of foregone salary) paid the premium for it while you were employed. It is technically not supposed to be a government dole. So technically, even that is not supposed to be a problem.
Why dont you spend a few hundred dollars to get a consultation with a good immigration attorney? The potential impact if something goes wrong is way too much for you to rely on questionable advice from strangers in an internet forum.

I am on F1 visa. I enrolled in one of the university. I don't attend university in person. I do attend classes online from another state. My question is that I am resident of which state ?? Will I be automatically resident of state where exactly my university is ? I know it is mandatory to attend classes in person on F1. Can you please advise ? How is residency considered ?

LCA for H1 not for GC processing. My GC LCA is difefrent than H1B LCA .
I am not sure if any New LCA is required for 485 ...At least my company has not initiated any new LCA..
But they do file for H1B(LCA) if there is any change in work location.

I wanted to introduce myself as I am new to this forum and digital photography. I have always had a keen interest in photography but never got around to doing anything about it until now. I just ordered my first real camera, I bought a Nikon D70s with the 18-70 and 55-200 lenses, and it should be here by the end of the week. My job provides me the opportunity to see many different places around the world and I am hoping to get good enough to capture and share the sights and feelings of my travels. My wife and I also enjoy motorcycling and get to see a lot of the country that you miss if you take the interstate and hope to capture some of these sites as well. Last year i filled AR-11 manually and mailed with 39 cents to USCIS . Even though My Approval papers went to old address and then went back to USCIS. Later on I called them and gave the new Address then only they sent again to New Address . I don't think USCIS will see our AR-11 forms .

There may be other avenues to get AP for a longer period. EAD nothing to do with your 485 processing. Without EAD you can get AP if 485 is pending.

This is my first time posting here and hope that it would ease my path.
I am trying to find if any one had the experience or has known about someone filing and H1B with a BSc in Health Sciences in Health Care with Respiratory Therapy option.
I know it is not possible to get an H1B on Respiratory therapy therefore I am looking for options as a healthcare administrator, health care analyst, health informatics, etc.
I have done alot of courses in computers like: MS applications, Oracle, Unix, Windows Adminstration, etc and I am close to get an associates in CS too.
Question:
- Are there any healthcare fields that require Bachelors degree to get H1 in my case?
- Can I work in IT and get H1 if the job description says Bachelors in any field?

ESTA is valid for 2 years - you only need to do it eithere every 2 years or when your passport expires - whatever comes first - my sister in law is using it to come to the US next week for Thanksgiving and had to sign up for the ESTA a couple of months back when she booked her ticket.
Only thing is it's for Visa Waiver countries at the moment - although I suspect that they would extend it to anyone who has a visa at some point. I believe that's the same thing that the Australians do.
