Hello every one,
I am starting this thread for all of us not to just think about the GC process. If any one is residing here for 10 years without GC, think about making a law which can lead us to Citizenship. My thoughts on this:
Many of our colleagues who landed with us during the late 90s (1998, 1999) and early 2000, who got their GC without any issues are now Citizens or waiting to become Citizen soon.
What is our status?. Just think. Still we are strugling to get the GC. Even by law change, if we are getting the GC this year (by GOD's Grace), then we need to wait for another 5 years from now (approximately 2014). Many persons like me who have come to this Country in their later career will be very much affected due to this delay (we have lot of other issues like the dependents reaching the age of 21 etc., College, University fees etc.,).
Core team and every one, please consider this and try to lobby for getting the citizenship without further wait if the persons satisfy the folowing conditions:
1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
2. If they have earned full 40 points in Social Security
3. If they have paid the tax continuously for 10 years
4. If they own a house and paying Mortgage (adding weightage to the Economy boost)
and
5. If they do not have any criminal records in these 10 years.
Please again do not just concentrate on the GC issues. Consider this and if any one can come with a letter draft with legal openion, we can send it to all Congress members, State Governers etc.,
Hope the members and the Core team consider this issue. I have one more thread on this, which I started some months back but the response was not that good. If every one of us unite on this and raise this to the Congress, I think the new Government may consider as this is very genuine.

The very people tossing aside ethics are the ones who used good faith based credit system. Now suddenly it is all Capitalism, Greed, Bank's and Lender's fault. Whatever happen to personal responsibility ?
All those suggesting foreclosure are forgetting one thing: The pendulum has shifted and the same capitalism that supported the reckless credit is now going to choke it off. You don't want to be on the wrong side twice !!!! The thing about free markets is they adjust to new realities long before people do.Before you know it the easy walking away (or foreclosure) might become the biggest mistake while buying house might be distant second.
In the meanwhile please don't shoot the messenger aka sledge_hammer. If you read his posts he has given the best advice with a good dose of much needed reality and sound language. If you are hostile towards him you are simply in denial. The longer you stay there the harder it will be to cope with the new realities.

You will earn it back but you can't undo foreclosure and whatever comes with it in terms of personal memory, your credit and things in future that you can't foresee now. Do the right thing it will only make you stronger and someday you will be able to tell your kid that you did the right thing in the face of adversity and eventually not only survived it but thrived out of it.

I am guessing that we are on our own on this, it will be an unnecessary headache for them. if they go ahead with any movement on this issue EB 2's will get pissed off, if they dont respond positively then the EB3's will react negatively

The real message in this thread is that you should check what is required by the countries you intend to transit BEFORE you buy your ticket.
It seems to me that an individual should take responsibility for his own actions rather than trying to blame a particular country for a long established requirement for a transit visa.

why ? is that how you respond to a co-worker or manager at work, if you do not agree with them ? Repond like a grown up with rational arguments.
Setting aside moral and ethical arguments: three of your five suggestions are plain wrong, financially speaking:
taking new credit cards, buying a new car, renting an apartment. Interest rates are not locked and do you know, financial institutions can close your account and ask for the balance ? renters run credit report every time you extend your lease and can kick the renter out. These transactions may seem seamless for a person with decent credit but are extremely damaging for a person with very poor credit.
Leo2606, Being ethical is not a fancy word in business, in the long run (I am not talking about decades) your partners, customers and lenders will know about your practices and run away. Ethics and Morals are not something you take lightly especially when you are running your own business.

USCIS has to work in FIFO process not RIRO(Random In Random Out)... So they can't send Receipt Notice to Aug 17th filer and then look for July 2nd filer. I sent my concern to congressmen?

I fully agree that USCIS should work FIFO, but "should" does not make that happen. Clearly USCIS is not equipped for FIFI when truck loads of applications arrive. We may complain now, but I believe we should give them additional 10 days they need (to make it 90 days). I am equally worried about my July 2 filing. Nevertheless, I wish and hope the congressman's intervention helps.

My $0.02. This could be a pre-emptive measure on the part of AILA. There must have been some talk at the state department of mid-month regression. This might be a strategy to scotch that. Raise a ruckus and send a message that we are prepared to file a law suit. Who knows? We are mere pawns in this grand game. Whatever happens, I hope people keep some perspective and not lose sleep over this.

I asked my lawyer this, and he said that per a USCIS (Pearson?) memo you can change the underlying I140, but it applies to the same person. This is called interfiling. He said some people have taken this to assume that you can also request that underlying I-140 be changed across applicants, and primary-derivative names be flipped, but he is not sure if this will work, he has never done this in any case so far, and its a grey area.

its been 23rd day..H1B renewal..New Delhi..still waiting for PP..i got no slip ..no warning to wait ..nothing..
But now i think its not stuck due to PIMS..it could be anything ?? some admin processing ? some security check ? some name check ??
How do we differentiate what are our passports held up for..COULD THIS BE CALLED 221(g)..i read in forums..221g can take forever ??

Everybody here is on common grounds. We are all in this forum to help each other with only one objective: to obtain our green cards. There is no need to make assumptions to make each other feel bad. With all we have to go through with the retrogressions and whatever comes with it, this is the last thing we need. AND...No, sorry to disappoint you but I am not in the country illegally and I don't intend to commit fraud... is that clear?????????

While the USCIS numbers of pending I-485 make me relatively pessimistic on movement for India and China EB-2, the State Department�s internal case management staff are feeling more optimistic. In fact, we are seeing the National Visa Center issue fee bills for EB-2 India immigrant visa files with priority dates as late as November 2007, which would seem to indicate that NVC, at least, thinks the visa numbers will move at least that far ahead this year.
A caveat against reading too much into the NVC action: recall that it was imperfect information-sharing between USCIS and the State Department that led to the July 2007 �Visagate� debacle, and NVC likely has a small minority of the overall number of visa petitions with India and China EB priority dates in 2006 and early 2007, since so many of those beneficiaries could file for adjustment of status in July of 2007.
It�s also possible that NVC is simply trying to get cases set up with fees paid and documents submitted in case the numbers stay current for the rest of the fiscal year � but applicants would lose their filing fees if the numbers retrogress later this year.
We will have to wait for the May Visa Bulletin from the State Department, likely released by April 13 or so, for more detailed information on the State Department�s thinking.

I would not trust the lawyers in any of this, because their analysis will be superficial and not even close compared to what we see here. We have around 4-5 different folks here doing some really good sound analysis, so unless it's a lawyer known to historically make accurate predictions, I wouldn't care less about their say.

Yes, it is that simple. If you just walk away from your home, bank can only touch your home and credit history. They can not go after your automobile\gold\savings\other property....anything. You are not missing anything. That is why we are seeing so many people around us just walking away from their homes. Thank God I rent but if my property's value go down 200 k in 2 years, heck I would walk away with a smile on my face. No strings attached.
Walking away would have been difficuly had you put 20% down, i.e. involving your hard earned money in the deal. In that case you would have waited to see the market and hoped that it would revive. If put 0% down and bank has given you 100% loan, then it is the bank who has taken all the risk. You have practially no risk in that deal. Just like cloth....return it to the bank. Hey....you don't have to even clean it up...like you do in the case of apartment move. ;-)

Either employers think EAD is the student EAD which needs to be converted to H1 or they are ignorant.
My suggestion would be to not bring it up....and if it does come up tell the employer that you have work authorization and that the employer doesn't need to do anything. If that doesn't work, then someone is actively discriminating...
