    What Will It Take for Companies to Unlock Their Cash Hoards? (http://online.wsj.com/article/SB10001424052702303654804576349282770703112.html) By JASON ZWEIG | Wall Street Journal

    There is a cash crisis in corporate America�although it comes not from a shortage of the stuff, but from a surplus.

    In the first quarter, the five companies with the greatest cash hoards�Microsoft, Cisco Systems, Google, Apple and Johnson & Johnson�added $15 billion in cash and marketable securities to their balance sheets. Microsoft alone packed away roughly $9 billion, or $100 million a day. All told, the companies in the Standard & Poor's 500-stock index are sitting on more than $960 billion in cash, a record.

    To be sure, at many companies the cash piling up is at global operations that generate "undistributed foreign earnings" that can't be brought home, under U.S. law, without incurring taxes of up to 35%. But hundreds of billions in cash remain available�and idle.

    Meanwhile, the payout ratio�the proportion of earnings paid out as dividend income to shareholders�fell to 28.9% for the past four quarters. That, says S&P senior index analyst Howard Silverblatt, is the lowest level since 1936. Dividends are going up�Intel, UnitedHealth Group and WellPoint have recently raised them�but cash is still piling up far faster than most industrial giants can possibly find a prudent use for it. Of course, investors themselves might have a better use for the cash, if they could get at it.

    As Daniel Peris, co-manager of the Federated Strategic Value Dividend fund, says, "The likelihood of spending money poorly is increased by having a surplus of it."

    Microsoft's purchase price for the online telecommunications firm Skype, widely criticized as too rich at $8.5 billion, almost precisely matches the amount of cash that Microsoft raked in last quarter. Was that torrent of cash burning a hole in Microsoft's pocket?

    "No way," says Bill Koefoed, general manager of investor relations at Microsoft. "We see this as being a very strategic acquisition."

    The heart of the problem, as the great investor Benjamin Graham pointed out decades ago, is that the best interests of corporate management and outside investors are at odds. That is especially true for giant companies whose growth has been slowing. "The more dubious the company's prospects�the more anxious management is to retain all the cash it can in the business," Graham wrote. "But the stockholders would be well advised to take out all the capital that can be safely spared, because these funds are much more valuable to them if in their own pockets, or invested elsewhere."

    Amnesia is another culprit. In the past, companies paid out vastly more of their profits as dividends, and they should again. "If there were a greater historical sensibility among investors and managers," Mr. Peris says, today's low payouts "would be called out as an abnormal situation that's likely to lead to that money being less well-spent than it otherwise might be."

    Dividends have gotten short shrift in recent years as investors have come to favor companies that instead use cash surpluses to buy back their shares. Meanwhile, with the economic recovery barely out of the sickbed, many companies are reluctant to invest heavily in expansion. Others want to keep cash handy for potential acquisitions. So cash sits idle�even as interest rates, after inflation, are so low that cash often produces negative real returns.

    Benjamin Graham made three simple proposals in 1951 that deserve to be revived.

    First, investors need to realize that a company's cash is a valuable asset, even when interest rates are low; if management won't put it to good use, investors must speak up. As Graham wrote: "When the results on capital are unsatisfactory, it is appropriate for stockholders to�insist that it be returned to stockholders on an equitable basis."

    Second, companies should set formal dividend policies. Rather than paying or raising dividends out of the blue, they should state in advance what proportion of earnings they expect to pay out as cash dividends. If, instead, they plan to use excess cash to buy back shares, they should offer hard evidence that the stock is undervalued.

    Finally, Graham advocated that leading companies should pay out two-thirds of their earnings as dividends. That rate isn't as radical as it might sound, even though it would amount to more than a doubling from today's levels. The dividend payout, as a percentage of total profits, has averaged 52.3% since 1936 and 46% over the past two decades, according to Standard & Poor's.

    If the companies in the S&P 500 raised their payout ratio to 50%, Mr. Silverblatt estimates, that would put an extra $207 billion into investors' pockets�at a time when shareholders' dividend income is taxed at historically low rates.

    "Companies are basically earning more than they've ever made before, but their payouts are nowhere near that high," says Mr. Silverblatt. "They're holding their cash really tight. You can call them Scrooges if you want."

    Lot of folks talk about tax credit of 8000 in several threads, But, understand that a lot of us in this forum may not even get a dime in credit. There are income limits. Married and income above 170000 will get nothing.. nada. If the income is 165000, you will receive a mere 2000 and so on. Married with less than 150000 will receive 8000. For a single, the limit is 75K.

    If both husband and wife works in tech sector.. income will easily cross the limits and you will be considered too rich to buy a home and get credit... May be car credit might work for us as limits are higher... it only applies to sales tax charged on the first $49,500 of your purchase The income limit is high enough that nearly everyone will qualify. The credit starts to phase out at $125,000 for individuals and $250,000 for couples. Once you reach $135,000 and $260,000, respectively, you no longer qualify for car credit.

    Just as an example, this may be an anomaly, but I know this Australian Indian citizen, who has recently bought 2 houses in the LA Valley and is having no issues filling them with contractors so far (1 my friend), even in this economy. He works on SAP projects traveling on H1 , but is in Aussie land most of the time, with his family. The rent more than pays off his mortgage.

    to buy another house (if it is not distress property / from auction) just to put it on rent is stupidity ..risk is good if it is calculated ..to take foolish risk is foolishness ..anyway that is me. In this Country land is virtually unlimited !!! demand is low (see immigration ..they give majority GC's to people when they are 50 - 60 years old) and those who are young have smaller families because of high cost of living, way of living.

    ONE more reason for those who are on H1/ EAD is that 90% of then job postings on DICE and other places ask for only citizens or GC holders.

    my greencard is filed under EB3 category and it looks like a long wait. My PD is 2003 Nov and i am an indian. We've been debating whether to buy a house when 485 is pending. what is the risk involved? how many people are in a similar situation? I have twin boys and they are 3 yrs old now and it's getting increasingly difficult to keep them in an apartment. Now with housing market going down as well, we are in a tight spot and have to make a decision quickly. I would appreciate any suggestion in this regard.
    BTW - don't make a decision in a hurry - that would be pretty bad since it is almost irreversible for few years atleast. 4 of my friends brought a house and they are o.k. as of now except for the commute - though they admit that they are more tensed up now. one of my friend who brought a house 1 year back is cursing his decision to buy - I don't know if he is being honest or whether he chose a wrong house - these are the issues that he told me. his savings has gone down a lot as he has to pay much more for his house - atleast 3 times the rent amount (property taxes are high in his area). his commute is v.long now and he cannot come home for lunch - and because of long commute - he practically does not see his family on weekdays. his daughter has done free style painting on his walls and they had a crack on the walls (apparently he tried to reduce utility bills during extreme weather). his wife is now complaining that walking up and down the stairs is draining her strength. yardwork is literally breaking his back. his friend circle has gone down as he hardly gets time. more importantly he said his priorities were different and he wanted to make / save as much as possible etc - but buying a house has affected it. BTW he has a GC. ofcourse the above is one of the worst case. being on EAD is better than being on H1 - but still you are at the mercy of a govt agency (govt agencies are same all over the world - only here maybe they wear ties and don't watch TV at work - but then who knows :-)).

    Like anything else there are people of all kinds...there are h1b's who own a house and BMW's (and stock options in the valley) and there are h1b's that share a apartment with a couple of roomates to save some money.I have been here for 10 years and I have seen all kinds...basically what a h1b does depends on wether he is bachelor,family man ,his age , experience and his priorities in life etc..the only thing common is that everyone of them can be much more productive if they get permanent residency.A GC will give them a lot of choices and will give them wings to fly.

    You can enter USA on a different companies h-1b visa then the h-1b you are currently working for.

    However; the mistake people make is that at the port of entry; they give their h-1b documents and POE officer only looks at the companies name on the visa. They then issue the I-94 card in that companies name with the validity of the visa. This is something that happens frequently.

    Person has been admitted on company a's h-1b but they are going to work for company b. They are not watching because company b's h-1b notice of action expires later but port of entry officer gave i-94 card with incorrect company and incorrect validity date. If person overstays the incorrect validity date on the I-94 card then they would be considered to be staying unlawfully.

    The problem is that there is some guidance from the office of business liaisons which says that if a person has multiple h-1b approvals (notice of actions has I-94 cards attached with it), then they can work with all of them but just not at the same time. That is person can transfer from company a to b to c and if they wish they can go back to company a without filing for change of employer. However; it gets very murky when person leaves and re-enters and enters on wrong company h-1b with incorrect validity dates.

    In our case,when my daughter came to US in May 2003, we had the i94 original(which we didn't keep the photocopy for our records),filed for her H4 etxn,went to Toronto for H1/H4 stamping,in 2 months when we went for vacation to India, gave away that i94 card at the airport while exiting and re-entered with a new i94.

    I can still see that i94 card lingering in front of my eyes..for which I dint keep a photocopy..

    Well, my dear freind you obviously did not understand what I meant. I still maintain that Kashmir is the root of the problem and India has nothing to gain by keeping it. Caring for India and Caring for Kashmir are two different issues. The very reason , I want to cut off the cancerous finger is to prevent the spread of cancer to the other parts.

    On the other hand if some is attacking me in my home and/or hurting my family or freinds, I have full rights to defend and call of justice to prosecute the attacker.

    More than the people of Kashmir or the land of Kashmir, it is the waters of Kashmir that is becoming a huge issue. This hasn't gotten a huge attention in the media. I read an article in one of the foreign affairs magazine at a local book store and they have explained this issue at length.

    And who told you SKIL is killed or that numbersUSA killed it ? In fact they are quaking in their boots at the thought of congress passing some large scale immigration relief measure like SKIL during the lame duck session. Take a look at their site for the latest "action item". Sad part is many of their friends in congress have either lost their job or are busy licking their wounds.

    It is time for IV to do its job by letting the truth out. The claim that H1Bs do not pay any taxes are outrageous. They should know that H1Bs pay all the tax but do not enjoy the benefits, e.g., when they get laid off, they have to leave the coutry right away without getting a penny of unemployment benefits. They will not get the social socurity benefits if they do not work in the U.S. for at least 10 years while their visas only allow them to work 6 years in a row. Such unfairness can go on and on...:mad:

    I try to avoid long posts, as well as obviously silly ones. I also pick and choose sometimes.
    Otherwise it takes up a lot of time.

    Let me try to sum up my logic, and my beliefs. I'll try to be brief.

    1) There are militants running around in Pakistan that want to provoke India into a conflict with Pakistan. These are the same people who blew up Marriot in Islamabad, and killed Benazir, and tried to kill Musharraf twice.
    2) If they succeed in starting an India/Pakistan 'cricket match', that would provide them with relief, and give them more room and more chances to grow.
    3) If they don't succeed, they will probably try again, and again, until they DO succeed, which would be a disaster. And therefore, it is absolutely necessary that Pakistan investigates and gets to the bottom of Bombay.
    Unfortunately, in Pakistan, I am seeing denial. That is not good.
    4) Steps that convert the situation into an India-Pakistan cricket match must be avoided. In the past, India and Pakistan have tried to score points against each other, and supported insurgencies and tried to destabilize the other country. Some of that probably goes on today as well. So, this childish and silly cricket match should stop.

    So, that probably sums up what I think. I don't know if I contradict myself anywhere; maybe I do. But its a very complex situation, with no easy answers.

    India-China Relations Negotiating a Balance (http://www.ipcs.org/pdf_file/issue/IB160-Banerjee-India-China.pdf) By Dipankar Banerjee | Institute of Peace and Conflict Studies.

    Now that Chinese Premier Wen Jiabao�s visit to India in Nov 2010 has ended, it is necessary to reflect on the nature of India-China relations and where it is headed. Kishore Mahbubani, the distinguished Asian thinker from Singapore, described India-China relations as, �the most important bilateral relationship of the 21st Century�. Indeed, historically, civilizationally, from the perspective of economic benefits to the region or from peace and security in Asia and the world; this is a relationship that is likely to shape the global future.

    There is no scope for mistakes. Two large nations that are simultaneously reemerging at a rapid pace, thus this relationship has to be based on carefully balanced enlightened self interests. To achieve this will call for delicate negotiations based on our respective genius, taking account of our differences, yet accommodating the genuine concerns and interests of both. It is important to be clear that tension and conflict, easy to generate in an atmosphere of fear and distrust, can do immense harm to all.

    HISTORICAL & CULTURAL LEGACIES

    Historically near neighbours, India and China had very little contact or understanding of each other. Two long but intermittent periods in early history may be considered as exceptions. One was the epoch of the Nalanda University in India, which flourished nearly two millennia ago and brought the world�s scholars to its gates. This was amongst the biggest confidence building measure in the history of Asia. The other was through the Great Silk Routes emanating from China with some branches passing through India and going to the world, enriching both countries. This was an early example of globalized commerce that benefited the entire then known world.

    The absence of recent contact failed to develop in India an understanding of the �Middle Kingdom�. On its part China has never quite grasped the importance of democracy, pluralism and diversity of India, which with all its imperfections, constitute the quintessence of the Indian state and its nationalism.

    Instead, our awareness of each other in modern times can be traced to the 19th Century, where it was coloured by colonial influences with their national interests firmly centred in European capitals. This brief interlude in history was the only period when neither India nor China was a leading nation in the world with neither in a position to shape its own destiny. Yet, it may be argued that spared outright conquest, Beijing secured its national interests somewhat better than Delhi. Many of today�s problems originate from that period, even though goodwill between both nations remained intact. Examples from India were Rabindranath Tagore and Dr Kotnis.

    In his highly controversial first visit to China in 1924 Tagore said at a lecture in Shanghai, �I want to win your heart, now that I am close to you, with the faith that is in me of a great future for you, and for Asia, when your country rises and gives expression to its own spirit -a future in the joy of which we shall all share.� Tagore visited China purely as a poet, yet his words set the tone and trend for India-China relations till the 1950�s. Premier Wen Jiabao hit the right note, when in his first engagement in Delhi in 2010 he visited a school named after Tagore and drew attention to the renewed attention in China today to his humanistic writings.

    Congress Party sent a small medical mission led by Dr Kotnis to help the Eighth Route Army in its War of Resistance in 1938. This team�s dedication and service to the People�s Liberation Army left a deep impression in the minds of the members of the Long March generation. This was the backdrop in which Nehru reached out to China in the 1950�s.

    A rude awakening to the Cold War realities of the 20th Century came about in the deteriorating relations in the end of 1950�s and to the 1962 War. The impact of this was different in the two countries. In China the average citizen had little knowledge of this War. They were in the grip of a totally controlled media. Besides, the population at large was grappling with life and death questions of the consequences of the Great Leap Forward. But, the impact in India was traumatic. Essentially it transformed in to a deep sense of betrayal at several levels, a sentiment that left deep scars.

    This contrast was reflected personally to me in June 1991 in many places in China where as a General Officer of the Indian Army and as the first Indian military guest of the PLA in over three decades, one was repeatedly accosted with the statement; �there are a thousand reasons why we should be friends and none at all why we should be enemies�. This was a sentiment that few would have shared in India at the time. As a first step in reconciliation we need to put this current history firmly behind us. This possibility was brought home to me personally through a brief encounter in Vietnam in the autumn of 2010. Shocked to see the utter devastation caused to innocent Vietnamese civilians in the most massive bombing in world history, in the deep underground bunkers north of Ho Chi Minh city, we asked if it was possible to forgive an enemy that caused these horrors. I was struck by the response of the young Vietnamese guide. He said; �If we were to hate the Americans, then how can we not also hate the French, the British, the Australians and the Chinese? We need to put history behind us if we hope to build a future�.

    Many would object to this idealistic approach to hard issues of national interests and they have a point. But, continuing with historic animosities is not the best foundation for national policy. In the realpolitik world of the 21st Century we will need to carefully craft a balance between our concerns and interests and evolve a cooperative relationship.

    THE NEED TO CHANGE MINDSETS

    The litany of issues between us is long and complex. A short paper such as this will only indicate broad approaches that India should adopt on some of the more important issues.

    The border issue easily heads any list and is also the most urgent. Even though no shot has been fired in anger across the Line of Actual Control since the last twenty six years, an unresolved border can no longer be �left to the next generation� to resolve. Already more than a generation has passed since Deng Xiaoping�s statement and this generation has not proved wiser. There is too much at stake today to pend this issue for long. Lingering problems tend to fester and often can be brought to light from hidden memories to buttress misgivings on other issues. Political sensitivity of this issue to both India and China however, has to be accepted and haste has to be made even if slowly.

    The fundamental reality about borders in the 21st Century is that none can be changed arbitrarily between two sovereign nations of some consequence without causing great destruction. Copious blood has already been shed over this border and today both nations have substantial nuclear weapons as well as conventional arms capability to persuade us to rule out this option. If that much is accepted, the only option that remains is a negotiated settlement. There is no doubt that each side should be prepared to make substantial compromises. But, the framework of a settlement has already been agreed in 2005 at Premier Wen�s last visit in 2005 under the Agreement on Political Parameters and Guiding Principles for the Settlement of the IndiaChina Boundary Question. This clearly rules out the possibility of exchanging populated areas.

    While there may be concerns today to make the borders porous, access to holy lands and pilgrimage places should have easy though controlled access. This will address so called claims based on religious sentiments. Fortunately most places along our common borders are uninhabited and hence minor changes in lines drawn on maps should have easier chance of acceptance.

    The question of the Kashmir border with China has caused recent concern in India. This need not really be the case. Once again on the Jammu & Kashmir question the position of both India and Pakistan has evolved. An exchange of territory, howsoever desirable to either side is not a realistic and even a desirable option. Hence converting the de-facto to de-jure is the issue between India and Pakistan. This will also have to be the option between India and China. This would require a leap of faith and bold political leadership.

    Admitted that such leaps are not the preferred options for realistic politicians aspiring to return to office a background of trust and friendship has to be created. Which in turn should be based on carefully crafted win-win situations for both. This is where other major approaches become important.

    Well, one thing I can think of is how we treat the dead terrorists. In case of Parliament, Ashkardam and Mumbai attack, security forces killed the terrorists while they were killing innocents. As usual, Pakistan disowned them.
    Publicise very very heavily and spread the word that these dead bodies would be given non-islamic burial. Hit where it hurts them...After giving non-islamic rites, spread the word that next terrorist that gets killed would get more drastic treatment.

    BUT ensure that this treatment would be only for the foreign terrorists who are killed by security forces while doing their act and that are disowned by their country. It can be easily misused also. This should ONLY be done if nobody claims ownership of the body.

    The story we hear about Kasab is that he was a looser and a petty criminal who was brainwashed. If he and his ilks are willing to get brainwashed religiously then they can not discount the effect of propaganda about non-islamic rites for their dead body and possibly it might deter them from taking that ultimate step.

    Take a survey among the Muslims in Bombay to see if they support giving non-islamic rites for the 'orphaned' dead terrorists. I'm sure most of the sensible Muslims are outraged and they would agree to it especially after seeing what they saw on the TV. Before the killer's gun, there is no religion but only the intention to kill.

    Publicity is a good potent weapon, I agree.

    Although some of the dissidents were arrested for their involvement with social media, those outlets also have served as a balm, as families facing repression from the government try to contact the outside world. When human rights lawyer Jiang Tianyong was arrested in February, his wife, Jin Bianling, opened a Twitter account to record her efforts to get information as to his whereabouts, counting the days of his detention online to a crowd of several thousand followers. (Jiang returned home two weeks ago, but is under surveillance, and the couple declined requests for press interviews to keep a low profile.)

    Twitter isn't a medium known for its depth of emotion, but it was undeniably heart-rending when Jin described a conversation with her 8-year-old daughter one evening not long after Jiang's arrest. "Mommy," Jin recorded the child saying. "We shouldn't think about daddy much. You told me when I sneeze, it is a sign that someone is thinking about me. If we make daddy sneeze where he is now, he might be in even more pain."
