My attr said that uscis does not follow any chrological order to approve cases. Rather, it takes any 485 application filed before Jan 22, 05. So, your point on "giving more time" won't work here.
This is what I did. I did not get GC yet though, but got to know where I'm at.
1. Contacated NCS numerous times and raised two SRs.
2. Took inforpass a couple of times. Infopass IOs have more detailed info about our cases.
3. Contact Senator requesting that my appln be assigned to an IO, and it was done so. It is with an IO now. Hoping and praying that my IO picks up application to approve it this week.
4. Contacted Ombudsman late last week. Hoping to get some good actions taken on my application.
5. You might consider contacting Janet Napolitino as well.

I was asking for Ideas.. it is not just Kumar or some more people giving an idea that one should leave the house if the value of the house has gone down and now you have to move because of ur job and it is hard selling ur house where u may have to bear a loss ..
I already had conversation with american people ( not any desi's) in my office and they also had the same opinion as to leave a house if u have to leave because of job..
U tell me how wise it is to give a loan to a person without a down payment..The reason i said that other people are stupid is because.. i took an ARM loan of 5 years,, where i knew that i am not going to live in the house for more than 3 years and will later sell it..and there are people who knew that they are going to stay in the same house for more than their ARM period.. but didnt realize that they wont be able to make payment once the rate is re-adjusted.. i am calling those people's decision as stupid..
about me making a bad decision about buying a house.. well not 2 years ago..
i can sell the house for a loss of may be 20,000.. but why should i pay that money from my pocket.. i can keep that in my savings account and use it in my bad time..

People who knew they will be living for more than 5 yrs got ARM bcoz they have to pay less/month(max. leverage), house will appreciate and/or they can refinance when time comes. Ok, coming back to your case. I do not have any experience with foreclosure. From your post it seems like you are losing $20k. Well this does not seem a very big amount. Consider the impact of foreclosure, bad credit will mean you will not get any loan. It will be tough to get auto or any other credit. You carry risk with background checks. I think the lending standards will get tough going forward which means you don't know for how long you will not qualify for home. In my opinion, if you have 20k and it is matter of losing some savings, not going to foreclosure looks better option.
I hope you will learn to own up to your own mistakes, it will only make you better person in life. Good luck.

House Majority leader Tom Delay has resigned and will not seek the Majority post until next year. See here:

The house republicans will move to start working on electing a new house majority leader. Tom Delay was considered to be anti-immigration that tightened immigration laws according to anti-immigration organizations like www.numbersusa.com. He voted in favor of HR 4437 that is a nightmare for illegal immigration but does not address the ones already here illegally. And no, there is no mention of legal immigration facing backlogs in this bill either. Just enforcement to crackdown on illegal immigration. Voting "Yes" by any congressman on HR 4437 should not be construed as either supporting or opposing the legal immigration and/or retrogression relief.
There are 3 house members likely to seek the position and replace Tom Delay:
1. Roy Blunt (Missouri's 7th District). http://www.blunt.house.gov/
Roy Blunt has gotten poor grades from Anti-immigration orgs. However he voted to support HR 4437 that deals will illegal immigration. His views on legal immigration are unpredictable at best.
2. John Boehner (Ohio's 8th District). http://johnboehner.house.gov/
John Boehner has scored poor grades like Roy Blunt on immigration issues from Anti-immigration sites. However he too has voted to support HR 4437. His views on legal kind of immigration are again unknown at best.
3. Jeff Flake (Arizona's 6th District). http://www.house.gov/flake/
This is interesting. Jeff Flake is considered against immigration by Anti-immigration orgs. He got 100% marks by their grading system (God only knows how that grading system works on numbersusa.com, but whatever). He also voted to support HR 4437.

Can you add a dependent after your 485 is approved?
my lawyer said yes, the important things are that:
1. you must be married before teh I-485 is approved; otherwise the dependent needs to be sponsored under family petition etc. However note that in this case the dependent would be starting his/her I-485 at that point (when you are already approved) so will 'catch up' to approval later (and if dates retrogress, then the dependent is 'stuck' longer, without GC, while you will have your GC and all related benefits (ability to stop working, change types of work etc))
2. the date needs to be current for the dependent to file, but the fact that you got approved means that your PD is current (as you can only get approved when your PD is current)
Also, if I become a beneficiary on my wife's application, will I be able to maintain my H-1 status, and keep on renewing it?

My wife and I are now leaning towards independent filing, with no beneficiary for now.

Yup, that was my point - both are greedy :)....so no point blaming any 1 party. And agree with you that foreclosure is only an option if you 'really' can't pay your monthly dues and that too for a sustained period of time - if one has the money to pay the monthly mortgage, one should continue to pay it off even if the asset value as plummeted to rock bottom because that is what you have singed in for - the amount of loan you took out to buy that house. No excuse from that!

As per my knowledge, one can't file I485 application until and unless priority date is current. How come this report is showing 485 application count of EB2 after Aug 2007 priority dates.

So where is the correct interpretation? Does any body know?

I has also gone for Infopass appointment this morning. Office told me that my case has been under review since July 20, 2009.
So there is a chance that the case was approved sometime in the last 2 hours, but I dont see any updates anywhere. As mentioned in my previous post, I will call TSC again at 4 PM. I hope I can hear the same words from some other officer or I get an email or see online updates before that.

It would be interesting to see how many of the 'Yes' are going to remain 'Yes' when it comes to having their names on a lawsuit filed against USCIS (the whole list will be going to USCIS). Good luck guys.

Any way they don't really care about their own GC. All that they want is stop EB3 from moving over to EB2. Well, what's that, justice!

Thanks ... normal options in USCIS asks you to call ICE.gov ... BUT ICE.gov doesn't seem to have a local office.. please let me know if anyone out there has gone this route and any update regarding what all documents we need to produce to prove our case. Since its a Billion dollar company they are bound to fight the case (hopefully). Any information regarding the same is appretiate.
