I got an RFE to send copies of my degrees on nov 15th. my attorney sent the copies and my status changed to Response to request for evidence received and processing is resumed. How many days will it take for I-140 approval after the response to RFE to received by USCIS ?

Wait time for spouse to get a green card as a derivative from you would be apporximately 5 years since you already have your green card now. the best option is to wait for to get your US citizenship and them apply for your spouse and in that case the max. wait time os only 3-6 months. Hoep this helps.

Sure, you can apply for a new H1 petition with another employer..But do make sure to include the copy of H1 receipt from your pending H1 with a letter quoting you being in status based on the pending H1 petition...If you don't, there are chance that you might get the H1 approved without an I-94 attached as your current I-94 has already expired. In this case, you will have to leave the country, get the H1 stamped and re-enter US before being able to start work with the new employer...Btw, there is nothing like transfering a H1, thats just the term commonly used...Each petition is independent..
I would also make sure to address the issues from the current RFE so that another RFE is not received for the new petition.

Yes you would need a transit visa. In fact in Air India (not sure about other airlines) without transit visa you cannot even board the plane from US

Hello, I am on the same boat... kinda...
I submitted the application with supporting doc paper base on June 2 and they receieved and signed the package on June 7 to NSC
Til today check was not cashed. I called the service center and the lady told me to wait til July 8 to call them again and they will look in to it... and she said since it's summer time NSC is backing up.... and it does take up to 30 days to get anything.
(However, I have been reading... ppl efile seem have better luck to get any movement... some ppl got the EAD card within 20 days!!!!!)
I read some ppl also did paper and after a month... they go for the efile... but I still did not hear if that would creat any problems...
I don't mind to waste the 340 if it can make my EAD processed....
I would rather have the card in my hand then check my checking account everyday to see if the check was cashed....
anyone did both paper and efile after one another and got approved????
anything helps!

I'm going to use EAD under 1099 as an independent contractor, My employer asked me to fill only w-9 form when i joined the company.
My employer doesnt know whether i should fill I-9 form (employment verification eligibility) or not?

C# is a .NET language! C++, though, can either be .NET (managed) or unmanaged. You should clarify that with whatever job you are hoping to work on :)
The thing about .NET is that its main language is MSIL (Microsoft Intermediate Language). All of the .NET languages such as C#, VB, C++, etc. get squashed into MSIL.
I am utterly confused here. I see different jobs and stuff for .NET or c# or c++, etc. I thought they were all a part of .NET? Why for example, are the forums c# separated from c++, when they are both part of the same framework? I seriously can not wrap my head around this. If somebody says "I need some .NET work", are they referring to any language within .NET, like c# and c++? Please help me!

My AP is pending and my H1 visa on passport has expired like 3 months back. I am on valid H1 status which is good for another 3 years till 2010. I have scheduled H1 stamping renewal interview in India. Can there be any problems in H1 visa stamping as my AP application (I131)is still pending?

Alien registration number is found either on I-140 receipt/approval on top of beneficiary's name. If you're not sure, just leave it blank or put N/A. This is different from I-94 number.
concur it is the I-140 A# number if you have the approved I-140, otherwise check with your employer if they have the I-140, or leave it blank if your I-140 is approved.

My PD is Dec 2004 EB2 for a future jon offer. I won't be able to start the job until July 2008 as I am still completing my fellowship. I have read somewhere in the past that I can file I485 for this future job as the dates have now become current. Can anyone confirm this and any idea what is the general recommendation for the duration that I have to stay with this employer once I start the job.
Minimum 6 month is considered a safe period.

I am on F-1 and working under CPT from Jan 07 to Aug. 07 and will extend CPT from Sept 07 to Dec. 07.
I applied I-485 and 765 (EAD) as a husband on my wife's LC on July 2, 2007.
I will not be getting my EAD before Sept. 07.
My confusion is whether is it legal to extend my CPT on F1 even if I receive AOS receipt number ??

May be they should work on my 485 which is still in Initial review (per USCIS web site) and has not had a LUD change in an year.
