As a July 2007 filer, you do have to pay the $305 filing fee. The $80 biometrics fee applies only to applicants for Reentry Permits and Refugee Travel Documents. It is not required for Advance Parole.
Individuals who file for AOS after July 2007 have to pay a $1010 filing fee for the I-485, but are not required to pay filing fees for subsequent AP's and EAD's. The following is an excerpt from the USCIS website:
"Please note that, if you file Form I-485 to adjust your status as a permanent resident on or after July 30, 2007, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. You may file these forms concurrently. I am consultant and travel around. My company, a publicly listed company, is headquartered in Washington DC. For the I-485 filing, I got my medical done in my current project location in Florida and used my address in florida in the I-693 form.
My lawyer is advicing that I should be using the same address in my I-485 form. I have a 'permanent' adress in the DC area and I was thinking I could use that since I will be leaving florida within a year but I will follow my attorney's address and use the florida address.
Now to my question....
Would there be a problem later on if I update my address to my DC address after I recieve my Fingerprinting/EAD/AP. Any related comments will be appreciated

I guess it means nothing to us. My file has moved over the years from CA -> NE -> SJ NBC -> TSC.
TSC was the most efficient machinery USCIS had. Someone in NSC may not have liked this, so they are moving the old files to TSC to make it look just as bad. :D

I am July 2007 485 filer. I currently work on H1B and my spouse works using EAD. I alongwith couple of friends am thinking of starting a business. Plans are that my spouse would be the owner of the business / incorporation.
Has anybody gone through the same process : incorporation, immigration issues, etc. Would you pl refer / recommend a good lawyer for this?

Can someone please help me below question
I got my finger prints and Advance Payrol receipt numbers from USCIS but not I765(EAD). I called USCIS about EAD receipt nbr but they said "System not yet generated I-765 receipt nbr". My attorny and employer not responding abt EAD receipt numbers and someware I have doubt they did not fill my EAD's as they know after getting EAD i can work for other employer which is 6 months from receipt date. Is their anyway I can track whether they filled my EAD form or not?
Also please advise is thier any alternative way I can fill EAD's.

I am married to GC holder who is becoming USC on April 30. so i am sending my AOS application on May 1. Dont you think i am still in status since my H1b extension petition is pending????

Are you married to a USC? If so, you have nothing to worry about. Do not travel until your GC is approved as AP is not 100% safe for people that overstayed.

I live and work in the state which is under jurisdiction of TSC. I got my PERM approval from Atlanta National Processing Center. But for some weird reason, my attorney has mailed my I-140 & I-485 documents to NSC and it reached there today(07/27/07). My understanding is that my applications should have been sent to TSC directly. I am kind of worried now as my application has reached the wrong service center. Has anyone encountered a similar situation? Is there anything I could do now to address this issue? Even if NSC internally transfers the documents to TSC, will my receipt date be considered as the date they received at NSC? Is there any directive or memo from USCIS regarding this issue? Please advise.

Yes its true. Since 2008 Canada has been tightening the skilled immigration rules and has now restricted to mainly educated or worked in Canada or few occupations only.

Hi
My h1 extension is under process. Once it gets approved can I am thinking of going to canada and get it stamped. My wife has also applied for cos from h1 to h4. It was not applied with my h1 extension but was applied 1 month later.
My question-
Can we go for h1 stamping for myself(once approved) and h4 stamping for my wife , even though her h4 is pending.Would I-539 receipt notice would suffice .

As you will have a valid H4, you can try using H4 at the port of entry but it doesn't matter even if you use AP. If the Officer at the PoE objects or raise questions pertaining to your work status then you might want to use AP. Your status will not affect your spouse (or entire family) Green Card process.
Your status depends on your spouse's status. If your spouse is on H1B; you can always convert your status to H4 even if you use AP at the port of entry.

If you are maintaining H-1B status, you can file for status extension and will get new I-94.
If you are using EAD and have I-485 pending "status" then I-94 extension is not necessary.

its good to use your OPT card as long as its vaild and then move to H1, there is no time frame for stamping, its always good to go to your home country and then get it stamped,but once you start working on H1(your payrolls starts on H1) then your H1 clock starts
