I saw posts of several members extremely skeptical of the whole idea, even went on calling it stupid, crazy and useless. Some made mockery suggesting sending dead fish etc. I don't see any more posts from them.

Yes I was the one who suggested the dead fish. I belive in RESULTS, if sending these flowers actually ACHIEVES something, I will make a nice big biscuit of my words and eat them :).
Until we see ACTUAL "POSITIVE" RESULTS I am still going to be skeptical. Sure we have made a lot of noise and it has been heard by a lot of miscallaneous people. So were the rallies held by the illegals. What happened? NOTHING! So until I see some results YES I will STILL be skeptical.
Other than that, I really really really hope for everyone's sake, that this works and if it does I will eat my words and become a believer:)

This is the email I just received from CapitalOne:
"Sorry for the delay in responding. I've been out of the office unexpectedly and am now just getting a chance to catch up on past messages. Unfortunately we can't pursue candidates with EAD cards either."
There was a thread related to similar issues which I could not find. Apologies for opening a new one.
Doesn't the above constitute discrimination and illegal ? What recourse do we have when we are disqualified because of EAD ?
My neighbour just got a job at Capital One last week using her EAD . So I am not sure which policy this HR person is talking about. Capital One definately takes people on EAD and my neighbour is proof of it !!!

Thanks for your reply. Yes you are right but though I had the choice I was not allowed to enter on H1. Now when my AP is expiring on 01/26/2007 would it mean I may go out of status even if I have a valid h1 till 06/01/2007?

Hello every one,
1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
2. If they have earned full 40 points in Social Security
3. If they have paid the tax continuously for 10 years
4. If they own a house and paying Mortgage (adding weightage to the Economy boost)
and
5. If they do not have any criminal records in these 10 years.
You know some people meet all these conditions with the exception of approved i-40 and don't even have a pending Green Card application because their employers are just waiting for their H1 to be used up and then "kick them out".
I think if you meet all the conditions enumerated above, u should be automatically given a Green Card.

I never heard of an RFE for H1b extension. Are u sure that the RFE is not related to your I-140 or I-485?

- was it first H1/H4 stamping or renewal?
- do you have I140/I-485 application filed?
- did your employer do anything to inform the US consulate in advance about visa stamping?

People who have written letters themselves, post the Letters here. I am having 7-10 ppl in my office write the letters. It will be good if u guys can post the letter contents. I can simply have them write and sign with different letters. People are lazy dont wanna think and write.

Spatial, I agree with your views. There is nothing in INA which clearly talks about how the spill over should be allocated. USCIS is acting on its own whims and fancies. In last months' visa bulletin they mentioned questions were asked on how the spill over was allocated and decided to make it horizonal instead of the historical vertical spill over. So I am sure we should get some concrete answer how they decided to change it. Based on what ? which clause of INA states that ? I think we should all write letters to Mr. Oppenhiem demanding explanation on the same.

Another reason the companies give nowadays is "Unfortunately it is a government project and we cannot accept EAD status" - am baffled as to why they are OK with Green card and not EAD.

I have attended the Interview for H1 B renewal at the US consulate in Toronto (Although i see a lot of posts concerning US consulates in India....thought this might be helpful for someone who would attend an interviewat US consulate in Toronto)
I attended the Interview on Jan 16th at toronto for H1 B renewal and i got my passport back on Jan 23rd (4 business days as the officer told me as jan 21st is a holiday...martin Luther king day)
I have been speaking to some people at the consulate and for them it is taking 5-8 business days and for some they got it in 4 business days.....the worst i have seen is for a lady who was coming to the consulate from past 3 weeks everyday and there is no ETA on her status..(i hope she gets her passport soon:) )...
Unfortunately most of the people who attended there did not know of these delays and are struck cancelling and re-booking their flight tickets and extending their hotel stay
