Hi pakrish, similar situation here. My wife's gc has the gender mentioned incorrectly. From what I've researched, we need to file for I-90 and choose option D - correction in green card. There are no fees required as it's a USCIS mistake but the original card needs to be sent with the form.

Unfortunately there is no law that clearly prohibits descrimination based on visa status (at least I am not aware of one). In fact the legal pressure is just for the opposite, that puts additional burden on the companies to make effort in hiring local workers first. The corporation can always say they have a policy to not hire someone with temporary work permit and there is no law against it. It is sad but that's how it is.

Of course they can discriminate when they are going to make a final desition.It happens in USA a lot. If you have a pregnant woman probably you are going to choose one who is not. After we landed, the passengers were asked to exit the aircraft along with their carry bags. Many of us were puzzled as some of us wanted to catch up with our sleep. Reluctantly everyone had to leave the aircraft. Someone was saying there is another aircraft waiting to take us to India. Makes sense, that is why they asked us to take our cabin bags too. After we entered the building we were asked to take the left door. Behind the right door was a waiting room. A couple of turns led us into a corridor which was probably about 1/2 mile long. At the end of the corridor there was security check. Again I was puzzled, why security check now, we are already in a secure area. The transit visa form with those 111 questions suddenly came in front of my eyes. Nothing less than a new complete security check will satisfy these neurotic people. It was time to go thru the exercise again. Took off the shoes, wallet, coins, Jacket, belt, pants .... when I was gently reminder by the security guard that it was not required today. When my turn came to send the items thru the machine, I complained about the fact that I have to put my jacket in a bin that was probably used earlier to keep someone�s shoes. (And you know where the shoes go. And sometimes when it gets wet, it is not necessarily because of water. The thought itself was so revolting that I decided to get my jacket dry-cleaned after I reached India). Needless to say my protest landed on deaf ears. After going thru the security gate, it was time to go thru the final check. I assumed the flying eagle's position and was quickly scanned and cleared. Beyond the security point was the shopping and restaurant area. I was bit thirsty but could not force myself to spend on a bottle of water. I was so put off by this whole experience that I did not want to spend a single cent here. We looked at the monitor to find our gate and quickly proceeded towards it. Again we walked for about half a mile or so. Things looked familiar, but I quickly brushed off the idea. At the gate we presented our credentials and were admitted into the waiting area. Then again I got a sense of d�j� vu. I soon realized it was the same freaking waiting room that I saw earlier and the same aircraft was waiting for us. We needlessly walked for more than a mile, subjected ourselves thru security check. All this for what?
After waiting for an hour we were allowed to go into the aircraft to the same seats and surrounded by the same little pieces of garbage still on the floor. I congratulated myself for not buying the water bottle and looked out of the window to say final goodbye to London. Never again! Never.
Brit's think they are born twice & superior to the world and they can do better job in security checks then Americans....or as a matter of fact then any one else in the world?
I am not saying there shouldn't be any security checks but one thing is not clear or don't understand why do we have to go through security check process when nothing has could have changed in between flight take off from US and landing at Heathrow airport..I feel the possibility of someone getting into flight after its take off is ZERO chance....
What irritates me is when I travel through AIR-INDIA (proud passenger since 2001) stopover at London is right in the middle of night..you will be in deep sleep when it stops in London for fuel refill or some s*$^ we have to get down from plane and go through security check..it's so annoying I don't know when these security checks/stunts will STOP!!

Thanks trueguy!. It took me a while to realize that some people here are trying to misguide and misrepresent. Wish I had not spent so much of my time replying to those inane posts.
There is no basis for Oct PD to be at or near Jun 2007 PD levels, it is only to lull us into inaction. And I would be more than happy to be wrong about this :o
And it looks like some one was asked by their teacher to write imposition... and therefore we are seeing repeat dribble of the same post.

Now EB2 line will never end bcoz all new applications will come as EB2. Hoping for spillover after EB2-I becomes current is just a dream now that never comes true.

I agree we should focus on the task. There are lot of people trying to mislead and take the discussion off track. I will draft my own letter and send it this weekend. Its better if everyone writes there own letter. EB3 guys wake up and do something.

The real question is whether 2 files is ok with USCIS. Lawyers are giving different opinion on whether u can do it or not.
If u can file 2 sets, then do ead/ap on one.
They probably won't even look at my wife's 485 for a year. But I *think* that the EAD/ap should be under my wife's. Not sure though. I would like both asap.

We are planning to make a trip to Hyderabad, India along with my wife and my little baby boy. After reading all of your experiences, I am not sure which one should I opt for. We have an expired Visa on passport, planning to Use AP. As we are travelling first time with the little baby boy, I am looking for some hassle free flying. I recently traveled to Chennai. My H1b visa was expired in my passport and have an approved AP. I traveled through AA (Frankfurt) --> Gulf Airways (Bahrain) --> Madras and ultimately to Tirupati by Car, While going to India no one cared to ask for any documents not even in Frankfurt. By the way if you don't know this, you don't need a TV for Germany if you have AP. While coming back (I just came 2 weeks back), the officer at the Immigration counter looked at my passport and asked me how can i travel to US with an expired US Visa. I didn't give him my AP with my passport coz I was lazy to take AP from my bag. Finally I showed him my AP and he let me in. Now all the officers in India know about AP. They wont be surprised looking at the AP. In Bahrain I had a lay over of about 13 hours. Gulf Air gave me hotel accommodation. At the Bahrain immigration counter, the officer flipped 2-3 pages in my passport and didn't even care to look at my visa/AP. In Frankfurt, while boarding the AA flight to Dallas, the lady at the AA counter verified all my documents even my office badge. If possible carry your office badge/ID card with you. If you don't have one it should be OK because you are not required to carry and you can always tell them that you are not carrying. Since I showed her my AP, she took all my documents including my badge to her supervisor for the approval and finally gave me the boarding pass. In DFW the immigration was like a piece of cake. I was the second person in the queue. CBP officer after taking my finger prints took me to an officer (Secondary Inspection). The officer at the Sec inspection verified all my documents in his system and asked me to show my EAD. After checking my EAD, he said its not mandatory to carry EAD but safe. The whole process took less than 15 minutes. Let me know if you have any other questions.

After staying legally for so long, and suffering due to administrative lapses, I think we must ask for Citizenship. Nothing wrong absolutely. Just compare yourself with your friend who is applying for Citizenship, though you are equally eligible. Dont ask for less. NOthing against who got in.
When you have fulfilled the requirements, then you must get what you deserve.
When we post our requests and stories on sites incl obama'ssite, do make sure you mention about Citizenship also. Its not easy to settle back home with some situations like children etc..

By September 28 all the Visas are exhausted(2009 Quota). Please see the thread "September Visa Approvals". Infact some one was saying USCIS stopped issuing GC for the last week as they have used all visas. That may be the case they would have withdrawn approved GC
But try all the possibilities like SR, Infopass, Congressman, etc and let the local office be aware of Oct Visa bulletin and now are current and visas are available.

After such mad rush and bad news about visa bulletin revision? How many are considering to file on July 2nd and July 3rd? What is the general advice regarding filing from lawyers and oneself about sending documents on July 2nd and July 3rd?
My lawyer is sending through FedEx - overnight delivery - going there on July 3rd. My worry - Is it a huge risk on my part? What happens if Monday morning it is revised, or worst Tuesday it is revised?

As long as you are not committing crime, nothing wrong with making decisions which are good for you.
is'nt this exactly what the investment bankers and speculators on wall street did? It was not illegal (since Paulson and Dubya have deregulated the market so much) but it has now led to the biggest economic downturn in decades, has decimated the retirement savings of millions, and led to millions losing their homes and jobs. Nothing illegal, good for the people who made those decisions (millions in bonuses) but absolutely disasterious for society as a whole.
The core problem with system was cheap money because of lax lending standard and low interest rates ( blame Greenspan) and affordable housing (like ACORN from Dems). These decisions are made by people in power and so called smart people. Individuals do have their contribution to the problem but the macro decisions provided them means to have things which they can not afford. The bubble had to burst sooner or later ....

Those who bought houses to flip, or mortgages that they cant afford blame the lenders, the housing market, alan greenspan etc. The CEOs of the Detroit big-3 earlier this week blamed the economy, california emission standards, fuel prices etc.
WHat has happened to taking responsibility for their own actions?? Of all the financial firms it is the one doing somewhat ok: Goldman Sachs, which has cancelled bonuses for their execs. All these other firms which came tincan in hand begging for taxpayer bailouts should all also, by default cancel all salaries and bonuses for the execs. But no, there is no taking of responsiblity any more. Any problem that anyone in America has, is someone else's fault. Disgusting.
